Important: This document is an original travel-terms template prepared for Humsafar Trails using the requested reference structure. It is not a verbatim copy of another company’s terms. Replace all bracketed company/legal/contact fields and have Indian legal counsel review the final version before publishing or relying on it.
Humsafar Trails (“Humsafar Trails”, “Company”, “we”, “us” or “our”) provides travel planning, holiday packages, customized tours, group departures, accommodation coordination, transportation arrangements, sightseeing, activity coordination, visa assistance and related travel services. These Terms and Conditions (“Terms”) govern your access to our website, booking channels and travel services.
By making an enquiry, paying an advance, confirming an itinerary, using our website or otherwise engaging our services, you acknowledge that you have read, understood and accepted these Terms. Where a destination, package, quotation, booking voucher, invoice or written confirmation contains additional conditions, those conditions will form part of the agreement and will apply to the extent they are specific to that booking.
If you do not agree with these Terms, please do not proceed with a booking or payment.
“Client”, “Traveller”, “You” or “Your” means the person making an enquiry or booking, and includes persons travelling under a booking made by another person.
“Company”, “Humsafar Trails”, “We”, “Us” or “Our” means Humsafar Trails and its authorized representatives.
“Services” means travel-related services arranged, coordinated or facilitated by Humsafar Trails, including holiday packages, hotels, transport, flights, activities, sightseeing, transfers, visa assistance and related support.
“Supplier” or “Service Provider” means an airline, hotel, resort, transport operator, guide, activity operator, visa service provider, insurance company or other third party engaged to provide a component of the travel service.
“Package” means the itinerary or holiday arrangement confirmed for the Client.
“Departure Date” means the scheduled date on which the relevant trip or package begins.
“Booking Confirmation” means the written confirmation issued by Humsafar Trails after the applicable booking requirements have been completed.
Bookings may be made by persons who are legally capable of entering into a binding agreement. Where a booking is made for other travellers, the person making the booking confirms that they have authority to provide their information and accept these Terms on their behalf.
The Client must provide accurate and complete information, including names as appearing on identity documents, passport details where applicable, dates of birth, contact information, nationality, visa information and any other information reasonably required for the booking.
Humsafar Trails is not responsible for costs, cancellations, denied boarding, visa issues or other losses arising from incorrect, incomplete, outdated or misleading information supplied by the Client.
Humsafar Trails may act as a travel planner, organizer, booking facilitator or intermediary depending on the service. Certain components of a package may be supplied by independent third-party providers.
Our role may include comparing options, creating itineraries, coordinating reservations, communicating with suppliers, arranging transfers and providing customer support. Unless expressly stated otherwise in writing, Humsafar Trails does not own or operate airlines, hotels, transport vehicles or third-party activity facilities.
The exact inclusions and exclusions applicable to a booking will be those stated in the final itinerary, quotation, invoice or booking confirmation.
A quotation or itinerary provided before confirmation is an indicative proposal and may be subject to availability, supplier confirmation, fare changes, taxes, currency movements and operational conditions.
A booking becomes confirmed only after the Client accepts the applicable quotation/itinerary, provides required documentation, pays the required amount and receives written confirmation from Humsafar Trails.
Availability is not guaranteed merely because an option has been quoted. Supplier inventory may change until the booking is actually confirmed.
If a requested service becomes unavailable, Humsafar Trails may offer a reasonable alternative or revise the quotation with the Client’s approval.
Prices are based on the inclusions expressly stated in the quotation or booking confirmation. Unless specifically stated, the price does not include personal expenses, optional activities, meals not listed, travel insurance, excess baggage, visa fees, local taxes, city taxes, tips, porterage or other incidental expenses.
Government taxes, fees, fuel surcharges, airline charges, foreign-exchange movements, supplier price revisions or newly imposed statutory charges may affect the final price. Where legally and contractually permissible, such increases may be passed on to the Client.
For international travel, foreign-exchange conversion will be calculated using the rate applicable to the relevant transaction/payment unless the booking confirmation expressly specifies another method.
The Client must make payments according to the schedule stated in the applicable quotation, invoice or booking confirmation. Unless a different schedule is expressly agreed in writing, Humsafar Trails may require an advance at the time of confirmation and full payment before the travel date.
A booking may be cancelled or services may be released if scheduled payments are not received by the applicable due date. Any resulting supplier penalties, cancellation charges, fare differences or other costs may be payable by the Client.
Payments should be made only through payment methods and bank/UPI details officially communicated by Humsafar Trails. The Client should verify payment details before transferring funds.
Humsafar Trails will not ordinarily be responsible for payments made to unauthorized personal accounts, unofficial links or third parties not expressly authorized by the Company.
Flight bookings are governed by the applicable airline fare rules and conditions. Once tickets are issued, changes, cancellations, refunds, name corrections, baggage and other matters are subject to airline rules and applicable charges.
Airline schedules may change without control of Humsafar Trails. Delays, cancellations, denied boarding, missed connections, baggage loss and operational disruptions are primarily governed by the airline’s policies.
Any fare difference, airline penalty, airport charge or government levy arising from a Client-requested change may be charged to the Client.
Hotels and accommodation are subject to availability and the terms of the relevant property. Room categories, views, bedding arrangements, amenities and photographs may vary.
Standard check-in and check-out times are determined by the property unless otherwise confirmed. Early check-in and late check-out are subject to availability and may incur additional charges.
Hotel deposits, city taxes, minibar, room service, laundry, damages and other incidental expenses are generally payable by the Client unless expressly included in the package.
Where a confirmed property becomes unavailable due to circumstances such as overbooking, maintenance or operational issues, Humsafar Trails may arrange an alternative accommodation of comparable category, subject to availability.
Transport and sightseeing will be provided according to the confirmed itinerary. Clients are expected to be punctual at specified pickup points.
Vehicles may be shared or private depending on the package. Vehicle type, seating capacity and route may be subject to local conditions and applicable regulations.
Traffic, road closures, weather, local restrictions, mechanical issues, strikes, government instructions or other events may cause delays or itinerary changes. Humsafar Trails will make reasonable efforts to provide alternatives where practicable, but compensation is not guaranteed for services missed due to circumstances beyond its reasonable control or due to Client delay.
Cancellation requests must be made in writing through Humsafar Trails’ official communication channels. Cancellation charges will be determined by the cancellation terms stated in the relevant quotation/booking confirmation and the actual amounts retained or charged by suppliers.
Certain services may be completely non-refundable once booked, including but not limited to flights, visa fees, permits, event tickets, special hotel rates, promotional inventory, prepaid activities and supplier deposits.
Where a booking has a destination-specific or supplier-specific cancellation schedule, that schedule will prevail over any general cancellation language in these Terms.
Refunds, where approved, will be processed after receipt/reconciliation of applicable supplier refunds and deductions. Processing timelines may depend on banks, payment gateways and suppliers.
Humsafar Trails may need to modify, postpone or cancel a service because of supplier issues, safety concerns, government restrictions, weather, insufficient operational feasibility, force majeure or other circumstances beyond reasonable control.
Where practical, Humsafar Trails will communicate material changes and attempt to provide an alternative of reasonably comparable nature. Any refund, credit or alternative arrangement will depend on the recoverability of amounts from suppliers and the specific booking terms.
Costs incurred independently by the Client, including unrelated flights, hotels, visas, insurance or transportation, are not automatically recoverable from Humsafar Trails.
Requests to change travel dates, names, room categories, destinations, passenger details or other components are subject to availability and supplier approval.
Any rescheduling or amendment may result in supplier penalties, fare differences, administrative charges, revised taxes and other costs. A change is effective only after written confirmation from Humsafar Trails.
A booking may not be transferable to another person unless Humsafar Trails and the relevant suppliers expressly approve the transfer in writing.
Where Humsafar Trails issues a credit note instead of a monetary refund, the credit note will be governed by the validity period, permitted uses and other conditions stated on the credit note.
Unless otherwise specified in writing, a credit note cannot be exchanged for cash and may be subject to availability, prevailing package prices and supplier restrictions. Any difference between the new booking price and the credit value will be payable by the Client.
The Client is responsible for maintaining valid passports, visas, permits, entry permissions, transit documents, health certificates and other documents required for travel.
Humsafar Trails may provide administrative or coordination assistance for visa applications, but visa approval is solely at the discretion of the relevant embassy, consulate or authority. No visa approval or immigration outcome is guaranteed.
Visa fees, service fees and other application costs may be non-refundable irrespective of whether a visa is granted or refused.
The Client must check all tickets, vouchers, names, dates, visa details and other travel documents immediately upon receipt and notify Humsafar Trails promptly of any apparent error.
Travel insurance is strongly recommended for all domestic and international travel and may be mandatory for certain destinations or activities.
Unless expressly stated in writing, Humsafar Trails does not provide insurance coverage. Clients should arrange suitable insurance covering medical emergencies, evacuation, cancellation, interruption, baggage loss, delays, accidents and adventure activities as appropriate.
Insurance claims are subject to the insurer’s policy and conditions. Humsafar Trails is not responsible for an insurer’s decision to approve or reject a claim.
Clients must assess their own fitness and ability to participate in the activities included in or selected for a trip. Relevant medical conditions, allergies, mobility limitations or other circumstances that may affect safe participation should be disclosed where reasonably necessary.
Adventure activities such as trekking, rafting, skiing, paragliding, diving, biking, mountaineering and water sports involve inherent risks. Participation is voluntary and may be subject to age, fitness, safety and operator requirements.
Humsafar Trails may restrict participation in an activity where a safety concern exists. The Client must follow safety instructions issued by guides, operators, local authorities and Humsafar Trails representatives.
Clients must behave respectfully toward other travellers, staff, guides, local communities, hotels, transport providers and public authorities.
The Client must comply with applicable laws, destination rules, property rules and reasonable safety instructions. Harassment, violence, abusive conduct, illegal activity, possession of prohibited substances, deliberate property damage or serious misconduct may result in removal from a service or trip without refund, subject to applicable law.
The Client is responsible for the cost of damage caused by their intentional or negligent acts.
Clients are responsible for the security of their passports, money, electronics, jewellery, baggage and other personal belongings.
Humsafar Trails is not responsible for loss, theft or damage caused by airlines, hotels, transport providers, activity operators or other third parties, except to the extent liability cannot lawfully be excluded.
Clients should keep valuables secure, comply with baggage rules and avoid carrying valuables in checked luggage where possible.
Humsafar Trails will not be responsible for delay, non-performance, modification or cancellation caused by events beyond reasonable control, including natural disasters, extreme weather, epidemics, pandemics, war, terrorism, civil unrest, strikes, government action, border closures, political instability, transportation failures, supplier failures or other comparable events.
During such circumstances, Humsafar Trails may modify, postpone or cancel affected arrangements and will make reasonable efforts to assist with alternatives. Refunds or credits, if any, will depend on recoveries from suppliers and applicable booking terms.
Travel services may be supplied by independent airlines, hotels, transport operators, activity providers, guides, visa agencies and other vendors. Their own terms, conditions, safety standards, cancellation rules and limitations may apply.
Humsafar Trails will use reasonable care in selecting and coordinating service providers but does not control their day-to-day operations. Where a third-party service is defective, delayed or cancelled, Humsafar Trails will, where reasonably possible, assist the Client in communicating with the relevant provider.
To the extent permitted by applicable law, Humsafar Trails will not be liable for indirect, incidental, special or consequential loss arising from circumstances outside its reasonable control or from the acts or omissions of independent service providers.
Where liability cannot legally be excluded, Humsafar Trails’ liability will, to the extent permitted by law, be limited to the amount actually paid to Humsafar Trails for the affected service giving rise to the claim.
Nothing in these Terms is intended to exclude or restrict liability that cannot lawfully be excluded or restricted under applicable law.
The Client agrees to indemnify and hold harmless Humsafar Trails, its employees, representatives and authorized partners from claims, costs, losses, penalties or expenses arising from the Client’s breach of these Terms, unlawful conduct, inaccurate information, failure to comply with destination requirements, damage to property or injury caused through the Client’s intentional or negligent acts, to the extent permitted by law.
The Humsafar Trails website and related materials may contain itineraries, photographs, text, graphics, logos, pricing information, videos and other content. Unless otherwise stated, such material is owned by or licensed to Humsafar Trails.
You may use the website for genuine personal travel planning. You may not copy, reproduce, modify, publish, scrape, redistribute or commercially exploit our proprietary content without prior written permission.
Third-party trademarks and content remain the property of their respective owners.
Personal information may be collected and processed for booking, payment, travel documentation, customer support, supplier coordination, legal compliance and other legitimate business purposes, subject to Humsafar Trails’ Privacy Policy and applicable law.
By providing contact details and making an enquiry or booking, the Client agrees to receive service-related communications through email, telephone, SMS, WhatsApp or other official channels. Marketing communications will be handled in accordance with applicable law and available preferences.
Clients should first raise any complaint with Humsafar Trails through the official support channel or contact details provided in the booking documents. Complaints should contain the booking reference, traveller details, relevant dates and supporting documents.
Humsafar Trails will make reasonable efforts to acknowledge and investigate complaints within an appropriate timeframe. Resolution may depend on information and refunds received from third-party suppliers.

These Terms are governed by the laws of India.
The parties will first attempt to resolve disputes through good-faith discussion. If a dispute cannot be resolved amicably, the parties may pursue mediation or arbitration where agreed or where required under applicable law.
Subject to applicable law and any agreed arbitration process, courts having competent jurisdiction at [CITY, STATE] shall have jurisdiction over disputes arising from these Terms.
Humsafar Trails may update these Terms from time to time to reflect changes in services, supplier arrangements, technology or applicable law. The version applicable to a confirmed booking will generally be the version incorporated into or referenced by the booking confirmation, except where a change is required by law or mutually agreed in writing.
The confirmed quotation, itinerary, invoice, booking confirmation, destination-specific terms and these Terms together constitute the agreement relating to the relevant booking.
If any provision is found to be invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in effect.
